In Boston and throughout Massachusetts, police set up what they call sobriety checkpoints. They check every single driver who passes, seemingly striving to hand out as many DUI charges as possible.
If you have been charged with drunk driving at a sobriety checkpoint, we can help. We are the law office of James P. Geraghty. With more than a decade of experience on our side, we know how to take on any challenge that comes our way.
Sobriety Checkpoints Are Unconstitutional
Traditionally, the law requires that a police officer have probable cause to pull someone over. The officer needs to observe erratic driving or something else that would lead them to believe the driver is impaired.
Obviously, this does not happen at DWI/DUI checkpoints. Police simply stop everyone. If they smell alcohol, they conduct their field sobriety tests or breath tests. We believe that this practice goes against the guidelines set out by the Constitution. We are ready to challenge these stops on these grounds. We have been successful in doing so.
Our lead attorney is a former drunk driving prosecutor. This means that we have a unique perspective. We know the opposition’s strengths and weaknesses. We know how to challenge them, particularly when they are using sobriety checkpoints, which we believe are unconstitutional.
Our willingness to challenge sobriety checkpoints is just one reason that we have been able to obtain not-guilty verdicts or case dismissals for many of the people we have represented. We want to show you all of the reasons.
