JANUARY 2017
The defendant was stopped by a State Trooper after traveling in the wrong lane and almost striking the trooper head on. The trooper ordered the defendant out of the case and located a rum and coke in the center console, which the defendant admitted to drinking from while operating his vehicle. The defendant was unsteady on his feet and almost fell over several times while performing the field sobriety tests and the trooper discontinued all testing because he was concerning for the defendant's safety. NOT GUILTY TRIAL VERDICT
MAY - 2015 - New Bedford District Court – The officer reported that he stopped the client for swerving across both lane markers, speeding and driving down the middle of both the right and left lanes. The officer stated the client had bloodshot and glassy eyes, smelled strongly of alcohol, had heavily slurred speech, admitted drinking and failed the one leg stand field sobriety test. – CASE DISMISSED
October 2014 - New Bedford District Court – The officer reported he was dispatched to an accident where a witness indicated the client hit him, then “drove off and spun out.” The officer stated the client's car was facing south in a northbound lane, and when asked whether he or the male with him was the driver, he admitted driving, smelled of alcohol, had slurred speech and was unsteady on his feet. The officer reported the client failed the walk and turn field sobriety test as well as a counting backwards, stand on one leg test and finger-to-nose test. The officer stated the client kicked him and another officer during the booking process and admitted drinking two mixed drinks, two beers and two shots. – CASE DISMISSED
January 2014 - New Bedford District Court – The officer testified the client had been stopped for nearly striking the guardrail when exiting the highway, swerving on the ramp, slowing to 20 mph then accelerating to 40 mph, driving on the right shoulder several times and crossing the fog line. The officer stated he smelled alcohol coming from the client, saw he had bloodshot and glassy eyes, slurred, thick tongued speech and was difficult to understand. The officer testified the client fell toward his car when he exited, using his arm to brace his fall, was unsteady on his feet while walking, and he could not say the ABCs or count backwards as instructed. The officer stated the client failed the one leg stand and walk and turn field sobriety tests. – NOT GUILTY
