The officer testified he stopped the client for crossing the center yellow line, swerving to the right hand side of the road, and after stopping in the middle of the road, again crossing the center marked lanes and speeding up. The officer further testified he saw the client put two sticks of gum in his mouth and light up a cigarette, noticed an odor of alcohol, slurred, thick-tongued speech, red, glazed over eyes and a stare in his eyes. The officer stated the client admitted having one beer and after exiting his car, could not say the alphabet or count backwards as instructed and failed the walk and turn and one leg stand field sobriety tests. The officer further stated the client later said he had a few drinks. NOT GUILTY

Client is pulled over for speeding and cannot produce his license and registration. The police officer observes client eyes to be bloodshot and glassy and his speech to be slurred. Client is asked to exit the vehicle and perform the field sobriety tests. Client refuses but at the station elects to take a breathylzer with a reading of .12 which exceeds the legal limit of .08. NOT GUILTY
